Attaching the infant car seat by using the Britax Römer Baby Safe i-Size Flex Base or the Baby Safe i-Size Base (not included in delivery!) is very simple. Colour indicators signalise whether the infant car seat has been installed correctly and provide additional safety. Alternatively, you can install the infant car seat Baby Safe 2 i-Size by using your car's own seat belt.

參與犯罪組織一律強制工作最高法院聲請釋憲

（中央社記者蕭博文台北11日電）黃姓男子加入詐欺集團3天，被判刑1年4月，另被法院依組織犯罪防制條例要求強制工作3年。最高法院認為，該規定未區分情節輕重一律要求強制工作恐違憲，決定聲請釋憲。

最高法院今天發布新聞稿指出，組織犯罪防制條例第3條第3項關於參與犯罪組織者，不分情節輕重，一律強制工作3年，已違反憲法第8條正當法律程序及第23條比例原則，且為本案適用法律的先決問題，決定聲請司法院大法官解釋。

全案起於黃姓男子加入詐欺集團擔任機房人員，負責撥打電話詐欺中國大陸民眾，因話術不成熟未得逞，短短3天即被警方查獲，二審時被依詐欺未遂罪判刑1年4月，強制工作3年，向最高法院提起上訴。

現行組織犯罪防制條例第3條第3項規定，發起、主持、操縱、指揮或參與犯罪組織者，應於刑之執行前，強制工作3年，3人以上的詐欺集團適用這條規定。

最高法院認為，現行規定不分輕重一律要求詐欺集團成員強制工作，已違反憲法正當法律程序及比例原則，況且近來一、二審法官審理此類案件，或私下向最高法院法官請教，或於法官論壇發文，都嚴重質疑規定的合憲性，此項爭議亟待解決，希望大法官趕快做出解釋。

最高法院指出，大法官會議雖曾就該強制工作規定做出釋字第528號解釋，認為不違憲，但現行規定擴大組織犯罪的範圍，及於非暴力型態的詐欺集團，已與解釋時不同，時空背景也不同。

最高法院進一步指出，過去組織犯罪構成要件須兼具集團性、常習性、脅迫性、暴力性，因此認為組織犯罪者有強制工作必要，但現行規定只要符合持續性或牟利性之一即構成組織犯罪，釋字第528號解釋有變更必要。

最高法院認為，組織犯罪防制條例對於參與組織犯罪情節輕微者，有減輕或免除其刑的規定，因此被告也可能獲判易科罰金之輕刑，但依現行規定，仍得依法判決強制工作3年，亦有違比例原則。（編輯：方沛清）1071011
